On July 31, 2026, Weil secured a complete victory for Attalon, obtaining the dismissal with prejudice of a high-stakes federal trade secrets action brought by the multi-billion dollar incumbent nLIGHT in the U.S. District Court for the Western District of Washington.

Attalon, a manufacturer of precision optical and laser technologies for commercial and defense applications, was sued after a top nLIGHT engineer joined the company. nLIGHT sought emergency injunctive relief under the Defend Trade Secrets Act and asserted claims for threatened trade secret misappropriation, breach of contract, tortious interference and declaratory relief.

Following the successful defeat of nLIGHT’s motion for a temporary restraining order, Weil moved to dismiss the complaint, arguing that it relied on an unsupported inevitable-disclosure theory that sought to prevent the employee from working in his chosen field based on an unenforceable restrictive covenant. The motion also highlighted Attalon’s extensive efforts to safeguard against the use or disclosure of any confidential information.

nLIGHT opposed the motion to dismiss and threatened to multiply the litigation, with both a court case and an arbitration. But the day after Weil completed briefing on the motion to dismiss, nLIGHT voluntarily dismissed the action with prejudice without any payment by Attalon.
