Outside the NFL, in February 2024, Disney, Fox, and Warner Bros. Discovery announced the creation of a joint venture to launch Venu Sports, a streaming service that proposed to distribute those media companies’ sports content direct to consumers. Fubo, a live-TV streaming service, brought an antitrust suit seeking to block Venu’s launch. After the court entered a preliminary injunction to temporarily block Venu’s launch, the matter was resolved by settlement wherein Disney’s Hulu will seek to acquire Fubo, and Venu has been discontinued. Both of these lawsuits foreshadow how, as the fragmented broadcast landscape continues to evolve, broadcasters and rights holders will seek innovative solutions to ensure the success of their platforms. Relevant parties should consider not only how and where viewers want to consume their content, but also the antitrust and other legal implications of business ventures designed to meet consumers’ changing needs.
