In the 2021 edition of Benchmark Litigation, Weil again scored top national firm and individual honors for our trial capabilities and track record.

On an individual basis, Weil partners David Lender, Jonathan Polkes and Diane Sullivan again were named to the Top 100 Trial Lawyers list. Messrs. Lender and Polkes have appeared on this distinguished list since its inaugural edition in 2018, while Ms. Sullivan now has appeared in the last two editions.

The Firm was also recognized as a national Top 20 Trial Law Firm, for the second consecutive year. As highlighted by Benchmark, some of the Firm’s notable recent trial victories include a major win for Carlyle Group in Delaware litigation arising out of an abandoned acquisition that breaks new ground in material adverse effect jurisprudence, and a complete defense jury verdict for C&S Wholesale Grocers in an $800M antitrust class action, which was recently upheld by the Eighth Circuit.

As Benchmark notes, “To call 2020 a challenging year for trial law would be more than an understatement… Trials were already growing increasingly rare even prior to the pandemic, with the pool of lawyers equipped to attend to this work steadily shrinking… As a result, the divide between 'litigators' and 'trial lawyers' has widened considerably, with the latter group commanding ever-increasing levels of reverence as masters of a seemingly endangered craft.”
