Weil Wins Willful Infringement Jury Verdict for Illumina to Keep Imitator Genetic Sequencers Out of U.S. Market

On November 30, 2021, Weil won a major jury verdict for DNA-sequencing leader Illumina in a closely watched competitor patent dispute in the U.S. District Court for the Northern District of California against Chinese conglomerate BGI, finding willful patent infringement of four patents. This win should extend the preliminary injunction Weil earlier secured that halted BGI’s U.S. launch of its competing DNA sequencers in 2020.

Co-Head of Weil’s Patent Litigation and Life Sciences practices Edward Reines led the trial team, which also included partners Doug McClellan and Derek Walter, counsel Melissa Hotze, and associates Andrew Gesior, Kathryn Leicht, Nate Ngerebara, Melinda Root, and Audra Sawyer.
