Jonathan Polkes, Co-Chair of Weil’s global Litigation Department, was interviewed by The Am Law Litigation Daily after winning a favorable summary judgment decision for Marsh & McLennan in a high profile dispute with former executives arising out of a New York Attorney General investigation into the insurance industry. Mr. Polkes discussed the potential impact this case will have on other employers in the context of internal and governmental investigations.
In his discussion with Am Law, Mr. Polkes noted the importance of this ruling in providing “clear guidance” to companies in situations where they absolutely require it. In the midst of a government investigation, companies have to consider regulatory implications, shareholder pressures, and private litigation, among other things, when determining how to proceed, and this ruling allows companies to elicit material information from employees to make better real time decisions.
