Weil Helps Secure Important Patent Victory for the Video Game Industry

Weil helped secure an important victory for the video game industry on September 24, 2014, when a California federal judge found two patents asserted against lip synchronization and facial animation techniques used by the industry invalid for failure to claim patentable subject matter.

Weil defended Activision Publishing, Inc.; Blizzard Entertainment, Inc.; Electronic Arts Inc.; Disney Interactive Studios, Inc.; LucasArts; Warner Bros. Interactive Entertainment; Bandai Namco Games America, Inc.; Sega of America, Inc.; Neversoft Entertainment, Inc.; Treyarch Corporation; Infinity Ward, Inc.; Atlus U.S.A., Inc.; and Capcom USA, Inc. against claims by Planet Blue that its patents covered fundamental methods to make video games that were being infringed by Weil’s clients and the video game industry broadly. Weil led the industry’s efforts in invalidating the patents by briefing and arguing the winning motion for judgment on the pleadings that the patents do not meet the requirements for patent eligibility.
