On July 10, 2019, Weil earned a complete summary judgment victory for HP Inc. and its customers in the sprawling multi-district patent litigation, In Re: Industrial Print Technologies, commenced by a plaintiff holding company controlled by mega-patent enforcer Acacia Research Group, Inc. Beyond that, the court ruled that two of the component cases in the MDL are “exceptional cases,” and thus awarded Weil’s clients attorneys’ fees. The plaintiff had sought tens of millions of dollars in damages.

The U.S. District Court for the Northern District of Texas, where the seven involved cases had been consolidated from the District of Delaware, the Eastern District of Texas, and the Northern District of Illinois, issued the decisions. With these rulings, the court has now granted summary judgment in favor of all defendants, finding that the accused HP digital printing systems did not infringe seven different patents asserted during this MDL, and resolving all claims against Weil’s clients HP Inc. and its customers Vistaprint USA, Inc.; Cenveo, Inc.; Fort Dearborn Company; Quad/Graphics, Inc.; and O'Neil Data Systems, Inc.
