Weil Class Cert Victory for Nortek Featured in Am Law Litigation Daily

A Weil Litigation team was featured in The Am Law Litigation Daily’s weekly “Shout-Out” column after defeating class certification on behalf of client Nortek Global HVAC in a putative product liability class action in Florida federal court. In this case, plaintiffs alleged that Nortek failed to disclose a purported defect in the copper evaporator coils contained within its HVAC systems, and as the Am Law article highlighted, plaintiffs sought a broad and significant class, including “everyone who bought the systems, even people who hadn’t had any problems.” But that proposed class definition, among other things, “didn’t go over well with U.S. District Judge Beth Bloom,” wrote Am Law, in summarizing the court’s 38-page opinion denying plaintiffs’ motion.
