Weil advised Fundusz Inwestycji Polskich Przedsiębiorstw Fundusz Inwestycyjny Zamknięty Aktywów Niepublicznych (the Fund), managed by Polski Fundusz Rozwoju S.A. (PFR), in connection with the acquisition of a controlling stake in PESA Bydgoszcz S.A. (PESA), Poland’s biggest manufacturer in the railway sector.
When closing conditions are satisfied, the Fund will ultimately invest PLN 300 million (approximately €69.7 million or $81 million) in PESA while indirectly taking over nearly 100% of the shares in PESA. The objective of PFR is to obtain control of PESA, and then to strengthen and develop the company, especially its export potential on European markets.
