Partner Allison Brown has been named a “Litigator of the Week” along with her co-counsel Morton Dubin of Orrick, Herrington & Sutcliffe for securing a complete defense jury verdict for Johnson & Johnson in the mass tort talc litigation. Following four weeks of trial in New Jersey state court, the jury returned a unanimous, 6-0 verdict after deliberating for less than 25 minutes.
The Q&A article calls this win a “slam-dunk victory.” This honor follows Ms. Brown’s recognition as “Litigator of the Week,” along with partner Diane Sullivan, in October 2018 for securing a complete defense jury verdict for Johnson & Johnson in a separate case in the mass tort talc litigation, also in New Jersey state court.
With regard to the brevity of the jury’s deliberations, Ms. Brown explained the team was a little shocked, but the verdict itself was not surprising given the strength of the science supporting the defense. “This was a jury that was paying close attention during the course of the entire four-week trial,” she said. “They took copious notes, some of them going through multiple notebooks, they asked questions and paid careful attention. These jurors had clearly been weighing the evidence throughout the course of the trial and were confident enough in their decision to deliver such a swift and unanimous verdict.”
When asked about how Ms. Brown and Mr. Dubin worked together throughout the trial, Mr. Dubin commented: “We both respect each other a lot and get along very well. We were thrilled to have the chance to try a case together.” Mr. Dubin also noted the enormous contributions made by the trial teams at both firms. “These folks were instrumental in creating a seamless working environment between our two firms and we all have a lot of fun working together.”
