Recently, Edward Reines, a patent litigation partner in Weil Gotshal and Manges’ Silicon valley office was quoted in
The National Law Journal. The article, entitled “Methods of Adjusting Dosages Patentable, Fed. Circuit Rules” dealt with the recent ruling by the U.S. Court of Appeals for the Federal Circuit on
Prometheus Laboratories Inc. v. Mayo Collaborative Services. The ruling reversed a lower court’s decision invalidation of Prometheus' patent on a medical procedure.
Mr. Reines explained why this judgment will spur advances in medicine: "In order to create incentives, you need a way to create a treatment that's not going to be copyable by everyone," he continued "Having groups all over the country with incentives to pursue innovation is a wonderful thing."
