7th Circuit Extends Reach of FTAIA

The Seventh Circuit overturned its own 2003 precedent and held that the Foreign Trade Antitrust Improvements Act relates to the merits of an antitrust claim rather than the subject-matter jurisdiction of a court hearing such a claim. This decision raises the burden for defendants moving to dismiss an antitrust case involving foreign conduct.
