Lori Schiffer is an associate in the New York office of Weil, Gotshal & Manges LLP, practicing in the field of intellectual property. Since joining the firm in 2002, Ms. Schiffer has been involved in numerous intellectual property transactions, counseling and litigation matters.
Ms. Schiffer has negotiated complex services agreements, patent, trademark, software and technology licenses, manufacturing and distribution agreements and website development and hosting agreements. She has broad counseling experience on a wide variety of intellectual property and technology matters, including use of open source software and the intellectual property consequences of filing for bankruptcy. Ms. Schiffer has also advised numerous prospective buyers, sellers and investors in connection with the intellectual property aspects of mergers, acquisitions, joint ventures and other corporate transactions.
A member of several litigation teams, Ms. Schiffer has conducted and defended depositions, drafted summary judgment and other motions and successfully defended eBay in a trademark infringement lawsuit brought by jeweler Tiffany & Co. involving allegedly counterfeit goods sold over the Internet. In July 2008, following trial, the United States District Court for the Southern District of New York rejected all of Tiffany’s claims, concluding that “[w]hile the law does not impose a duty on eBay to take steps in response to generalized knowledge of infringement, the record is clear that eBay, nevertheless, made significant efforts to protect its website from counterfeiters.” Ms. Schiffer has represented eBay in other matters, including a successful defense against a preliminary injunction motion brought by fashion designer Nanette Lepore
Ms. Schiffer has also handled a variety of pro bono matters for the firm, including representation of Hurricane Katrina victims, March of Dimes, Teach for America and the Brennan Center for Justice.
