A cornerstone of our Business Finance and Restructuring practice is the strong relationships we maintain with lenders and private equity and hedge funds around the world. Weil has represented creditors, agent banks, private equity and hedge funds, bondholders, statutory and ad hoc committees, first and second lien holders, and secured and unsecured lenders in claims against debtors, negotiating and litigating numerous dramatic recoveries for our creditor clients, often involving billions of dollars.
Our goal is to provide creditor clients with answers to their toughest questions and solutions to their most difficult quandaries in connection with their investments. We work hard to understand our clients’ businesses, relationships, and goals, and work to effect the right solution each time out, whether that be seeking immediate recoveries via litigation and negotiation or pursuing “soft restructuring” solutions, such as covenant resets, equity cures, debt buybacks, and standstills.
Weil also regularly represents lenders that provide postpetition (DIP) financing to chapter 11 debtors, as well as lenders that extend financing to purchasers of the distressed assets.
