Courtney Fain, an associate in the Employment Litigation practice group, has participated in the representation of clients in a variety of cases in federal court, as well as before several administrative agencies. She participated in the defense of complex employment matters, including class actions and single-plaintiff cases concerning Title VII, the Equal Pay Act, the Employee Retirement Income Securities Act, and other state and federal employment laws.
Ms. Fain has worked as part of several teams litigating putative class actions, including the defense of Forest Pharmaceuticals and Forest Laboratories in an action alleging claims of sex discrimination under Title VII and the Equal Pay Act, and the defense of UnitedHealth Group and several of its subsidiaries in an action brought by out-of-network ambulatory surgical centers alleging ERISA violations related to reimbursement of their claims. She also has participated in representing Marsh & McLennan Companies and several of its subsidiaries in a lawsuit brought by terminated executives, and was a member of teams representing Bank of Montreal and Comverse Technology.
Ms. Fain also has worked on several pro bono matters, including the successful defense of a non-profit social services agency against a charge of discrimination based on race brought by a terminated employee, and the ongoing defense of a non-profit organization against a charge of age and disability discrimination brought by terminated employee.
Ms. Fain also has experience counseling clients with respect to the Fair Labor Standards Act, the Family Medical Leave Act, the WARN Act, the New York Labor Law, restrictive covenants, drafting employment and separation agreements, crafting employment policies, and compliance with other state and federal labor laws.
Ms. Fain received her A.B., cum laude, from Harvard University in 2003. She received her J.D., cum laude, from Boston College Law School in 2008, where she was a senior editor on the Boston College Law Review.
