Diana M. Eng is a senior associate in the Litigation Department and a member of the Complex Commercial Litigation practice group. Ms. Eng’s practice focuses primarily on complex commercial litigation, as well as contested matters in bankruptcy proceedings, antitrust cartel investigations and intellectual property and media matters.
Ms. Eng has represented clients in the federal and state courts. These matters included an array of substantive issues, including breach of contract, fraud, breach of fiduciary duty, misappropriation of trade secrets and negligent misrepresentation. Ms. Eng was the lead litigation associate representing Washington Mutual, Inc. (the parent holding company of Washington Mutual Bank, the subject of the largest bank failure in U.S. history) in its chapter 11 case, which included three contested confirmation hearings. Ms. Eng continues to represent WMI Liquidating Trust, the successor-in-interest to Washington Mutual, Inc., in claims litigation. Other current representations include a foreign client in antitrust investigations in multiple jurisdictions, an insurance client in actions involving breach of restrictive covenant, tortious interference with contract and misappropriation of trade secrets and other related torts, and a major U.S. automobile manufacturer in mediations to resolve products liability claims.
In October 2007, Ms. Eng participated in a three-week trial in the New York State Court, Commercial Division, in which the firm defended certain Credit Suisse-affiliated entities in a dispute involving breach of contract, slander, fraud, as well as other alleged torts. Ms. Eng has also participated in all aspects of the representation of an insurance client in an arbitration, resulting in a successful settlement prior to verdict in a breach of contract claim against a major reinsurance company, and a media client in a trial, resulting in a full defense verdict in a dispute involving breach of joint venture, fraud and various related torts. In addition, Ms. Eng has successfully defended the City of New York at the trial level in civil litigation involving various tort claims.
Ms. Eng received her law degree from Columbia University School of Law and earned her bachelor of arts in English, summa cum laude and Phi Beta Kappa, from Barnard College. She also served as a research assistant to the late E. Allan Farnsworth, one of the foremost authorities on contracts. Ms. Eng is a member of the New York State Bar Association, the Association of the Bar of the City of New York and the Asian American Bar Association. She is admitted to practice in New York and before the United States District Court for the Southern and Eastern Districts of New York.
